Ordinance for Handicap Parking

NOTICE

The following ordinance was introduced and passed at first reading by the City Council of the City of Camden at a REGULAR meeting held on Tuesday, September 8, 2009, and is before the City Council of the City of Camden for further consideration for final passage at a REGULAR meeting to be held on Tuesday, September 22, 2009, at 5:00 p.m. in the Camden City Council Chambers, Second Floor, 520 Market Street, Camden, NJ.

The purpose of the following ordinance is set forth in the whereas and/or ordained clauses contained within said ordinance, which are incorporated in this statement by reference thereto as if fully set forth herein. A copy of the ordinance can be obtained by the public without cost from the Municipal Clerk’s Office, 520 Market Street, City Hall, Room 105, Camden, NJ, during the City’s regular business hours of 8:30 a.m. to 4:30 p.m., Monday thru Friday, except on City holidays.

AN ORDINANCE AMENDING AND SUPPLEMENTING THE ORDINANCE REGULATING TRAFFIC AND PARKING WITHIN THE CITY OF CAMDEN DESIGNATING ESTABLISHMENT AND PROCEDURES FOR CREATION OF ON-STREET HANDICAPPED PARKING AND AMENDING THE ADMINISTRATIVE CODE TO INCORPORATE THE ON-STREET HANDICAP PARKING PROGRAM

WHEREAS, N.J.S.A. 39:4 – 197 confers upon the City a right to establish resident handicapped on-street parking in order to preserve and safeguard the public health, safety and welfare; and

WHEREAS, pursuant to N.J.S.A. 39:4 -197.6, any municipality may, by ordinance establish a restricted parking zone in front of a residence occupied by a handicapped person if a windshield placard or wheelchair license plates have been issued for a vehicle owned by that person, or by another occupant of the residence who is an immediate member of the family

of the handicapped person, by the New Jersey Department of Motor Vehicles pursuant to the provisions of P.L. 1949, c.280 (C.39:4-204 et seq.), provided the permitting does not interfere with the normal flow of traffic; and

WHEREAS, the City Council of the City of Camden does deem it necessary to and in the best interest of its residents to provide for resident on-street handicapped perking in front of residences occupied by handicapped persons; now, therefore

BE IT ORDAINED by the City Council of the City of Camden that the Administrative Code shall be amended to add a chapter for handicapped on-street parking as follows:

               SECTION 1. The section shall be Titled – Resident Handicapped On-Street Parking and shall state the following:

Purpose – The purpose of the section is to establish a restricted parking zone, by ordinance, in front of a residence occupied by a handicapped person, which person has been issued a windshield placard or wheelchair symbol license plate for the vehicle owned by the handicapped person, or a vehicle owned by a member of the immediate family who resides with the handicapped person.

Authority – The section will be enacted in accordance with N.J.S.A. 39:4-197.6

Review Committee – There shall be established a committee to review and approve the placement of on-street handicapped parking. The members of such committee shall be Executive Director of the Parking Authority, or designee as approved by the Authority, the Director of Public Works or designee, and the Head of the Office on Aging in the Department of Health & Human Services. The committee shall establish application and review procedures for the approval of such designation; these procedures shall have the following:

Criteria – All those residences formally designated and having responded to the request for information by the City of Camden Parking Authority prior to these ordinances will be grandfathered and will not be required to pay the initial application fee nor the annual renewal registration fee for the first year. Any applicant who has applied prior to the effective date of this ordinance shall pay the application fee but shall not have to pay the installation fee.

There shall be two types of permits:

Type 1 – A handicapped spot will be allowed in front of the residence which shall be reserved for any handicapped operator.

Type 2 – The authorized location shall only be utilized by the applicant and only by the vehicle which license plate corresponds with the license plate number on the posted sign.

Fees: Application Fee – $20.00 fee payable to the Parking Authority – City of Camden for Type 1 designation
Application Fee – $45.00 fee payable to the Parking Authority – City of Camden for Type 2 designation

Installation Fee – Effective July 1, 2009: one time fee of $25.00
  Effective July 1, 2010: one time fee of $50.00
  Effective July 1, 2011: one time fee of $75.00
  Effective July 1, 2012: one time fee of $100.00

 

Annual Renewal Registration fee – $20 payable to the Parking Authority – City of Camden for either Type I designation
Annual Renewal Registration fee – $30 payable to the Parking Authority – City of Camden for either Type 2 designation

Violation and penalties – Any person improperly designated resident handicap parking restricted space shall be subject to the penalties under N.J.S.A.

SECTION 2. All ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed as to such inconsistency only.

SECTION 3. This ordinance shall take effect twenty (20) days after its final passage and publication as provided by law.

SECTION 4. If any provision of this ordinance is declared invalid, such invalidity shall not effect the other provisions of this ordinance. Furthermore, the other provisions of this ordinance are deemed to be severable and remain in full force and effect.

BE IT FURTHER ORDAINED, that pursuant to N.J.S.A. 52:27BBB-23, a true copy of this ordinance shall be forwarded to the Chief Operating Officer, who shall have ten days from the receipt thereof to approve or veto this ordinance. Notice of approval or veto shall be filed in the Office of the Municipal Clerk.
